A federal judge presiding over more than 6,000 mesh lawsuits in the C.R. Bard litigation has requested the parties involved select 200 cases for specific discovery to prepare for bellwether trials scheduled to begin next year. According to an Order [link to order] issued on March 25, 2014, these mesh lawsuits will go into a pool that will be further narrowed down and chosen to serve in the litigation’s second round of bellwether trials.

Additionally, according to documents in the U.S. District Court, Southern District of West Virginia, depositions in the claims involving C.R. Bard’s pelvic mesh inserts will be completed by October 3, 2014, and expected discovery is to be concluded by January 5, 2014. A second wave of bellwether trials in the C.R. Bard transvaginal mesh lawsuit litigation is expected to begin in early 2015, following the final trial in its first phase on May 19, 2014.

C.R. Bard Mesh Lawsuit Update

Thousands of women who received the Avaulta implants manufactured by C.R. Bard have allegedly experienced mesh erosion, infection, pain during sexual intercourse, chronic pain and other complications allegedly caused by the implants, according to records filed by TVM attorneys in the Southern District of West Virginia.

Additionally, plaintiffs and their TVM attorneys allege that the manufacturer’s products were negligently designed, manufactured and tested prior to their release on the market. Following their introduction, plaintiffs claim that they were not made aware of the potentially dangerous and life-threatening side effects. As a result of the complications, TVM attorneys across the country state that many women were allegedly forced to undergo often-painful and expensive revision procedures to replace or remove the mesh.

The trial involving C.R. Bard Avaulta implants in federal court in May 2014 will be the second for the manufacturer. When the first trial in the C.R. Bard litigation ended in August 2013, a plaintiff who received a device similar to Avaulta was awarded $2 million in punitive and compensatory damages.

C.R. Bard Avaulta mesh cases filed by patients and TVM attorneys are also moving forward at the state court level as well. In July 2012, the manufacturer was ordered to pay $3.6 million of a $5.5 million damage award at a California Superior Court hearing. As of March 29, 2014, a total of 1,003 Bard Avaulta mesh cases had been filed in a consolidated litigation in New Jersey’s Atlantic County Superior Court.
