Multi-Billion Dollar Verdict Against Drug Maker Prior to Actos Settlement

If approved, the Actos settlement would resolve more than 8,000 pending claims, with a baseline payment to each individual plaintiff reportedly in the $275,000 range. In 2014, a $36.8 million judgment was entered against Eli Lilly & Co. and Takeda to a plaintiff who claimed he developed bladder cancer from his use of Actos. In that case, the jury originally returned a verdict of $9 billion against the drug makers after hearing the evidence in the case.

In 2011, the U.S. Food and Drug Administration issued a public safety announcement of the potential risk of bladder cancer associated with prolonged use of Actos. The warning was based on a five-year study that showed an increased risk of bladder cancer for patients who used Actos long-term.

Thousands of Actos Cases Consolidated

More than 3,500 pending Actos federal court cases were consolidated into a multidistrict litigation (MDL) for pre-trial proceedings. Takeda has also been named in more than 4,500 Actos bladder cancer cases are pending in state courts across the country.
