The plaintiff in the case filed on January 16 alleges that he was fitted with a Biomet M2a Magnum in September 2006. He claims that he experienced pain, suffering and inflammation at the site of the implant after the surgery due to friction between the metal components. The plaintiff also alleges that the wearing of the all-metal components caused toxic metal ions to be released into his bloodstream, causing him to undergo revision surgery. He also claims that Biomet failed to disclose the risks of the device, which prevented him from discovering the initial cause of his condition.

Like many other pending Biomet hip implant lawsuits, this claim alleges that the M2a Magnum is likely to fail earlier than anticipated and that Biomet had knowledge of the problem. It also asserts that the metal-on-metal design is unreasonably dangerous and can lead to degeneration from wear-and-tear that disperses metal fragments into nearby tissues. The U.S. Food and Drug Administration (FDA) issued a consumer warning in 2013 regarding the risk of injury from metal-on-metal hip replacement devices. Many medical device manufacturers issued recalls of their products, but the M2a Magnum has remained on the market.

In early 2014, the manufacturer agreed to a $56 million settlement to resolve more than 2,000 claims against its all-metal implant. Plaintiffs who were fitted with the device and who underwent revision procedures more than six months after the initial implantation will receive a base award of $200,000 each.
