pelvic mesh lawsuit According to news reports, the woman was implanted with vaginal mesh in March 2011 to treat stress-induced incontinence, a condition characterized by urination with laughter, sneezing, coughing or other types of exertion. She alleged her incontinence did not improve following the implant and that she was left with chronic pain. Her husband was injured during intercourse as a result of the allegedly defective mesh.

The California couple also alleged the device manufacturer knew its product was defective and hid those defects from physicians. The vaginal mesh was allegedly heavier and sharper than others on the market, therefore more prone to shrinkage and erosion.

While vaginal mesh implants are typically designed to help treat stress-induced incontinence and pelvic organ prolapse, there have been lawsuits over synthetic vaginal mesh implants since the U.S. Food and Drug Administration (FDA) issued a safety notification in 2008. In the warning, the agency acknowledged it had received a high number of complaints about the devices, and three years later, the FDA acknowledged the risk of serious complications.

The verdict, one of the first of its kind involving Ethicon TVM devices, included $700,000 in compensatory damages for the plaintiff and $5 million in punitive damages against the device maker for what was described as “malicious” conduct on its part.
