Zofran Attorney Georgia

In 1991, the U.S. Food and Drug Administration (FDA) approved Zofran to help ease nausea and vomiting in patients requiring chemotherapy or surgical procedures. However, it came to the FDA’s attention that healthcare providers were also prescribing Zofran “off-label” for patients for whom the drug was neither tested nor approved, including pregnant women suffering from severe morning sickness. Babies have been born with birth defects allegedly caused by Zofran prescribed to mothers during pregnancy.

Babies born with heart defects such as heart murmurs, atrial septal defects, and ventricular septal defects as well as cleft lip or cleft palate have been reported by women who took Zofran during their pregnancies. Septal defects occur when the heart does not properly form, and holes are left in the organ, and cleft palates and lips, occur when the roof of the mouth and lip, respectively, do not completely form. In all cases, reconstructive surgery is required to correct the condition, and babies with cleft palate or cleft lip may also struggle with feeding and/or swallowing.

Zofran Litigation Beginning

In July 2012, GlaxoSmithKline reached a $3 billion settlement with the U.S. Justice Department to resolve claims that the drug maker illegally marketed Zofran by paying physicians to prescribe the medication to pregnant women. As a result, women who believe their babies’ birth defects were caused by their use of Zofran during pregnancy may have legal options, and these women are urged to seek legal counsel to learn more about filing a Georgia Zofran birth defects lawsuit.
