The DePuy Synthes Craniomaxillofacial (CMF) Distraction System is designed for patients with birth defects or those who are recovering from a post-traumatic injury. The device lengthens and strengthens the lower jawbone over time, but according to several reports, it may be prone to failure. As a result, the DePuy CMF jaw implant was removed from the market in April 2014 following indications that the device could cause severe complications such as respiratory distress and death.

DePuy CMF Jaw Implant Recalled

In April 2014, DePuy issued a notification to inform hospitals that the CMF jaw implant may reverse direction following surgery. If it reverses, the device loses its desired distraction distance. While this is not necessarily life threatening for adults, it can be for infants and younger children who lack the ability to “breath around” the obstruction. If this occurs, respiratory distress and death can result once the trachea becomes obstructed.

To date, there have been 15 claims of injury pertaining to use of the DePuy CMF jaw implant filed by patients. Failure of the device is likely to result in surgical intervention to remove and/or replace the allegedly defective unit. Due to the growing number of complications, the notification issued by DePuy, and the potential for injury or death, the U.S. Food and Drug Administration (FDA) classified the recall as a Class I recall in August 2014. While the FDA uses several categories to classify recalls, this designation is the most severe as it signifies a device that can cause serious injury or death.

Consider Seeking Legal Counsel

Patients in Georgia who have been fitted with the jaw implant and who suffered complications may consider working with an experienced attorney to learn more about whether they are entitled to file a DePuy CMF jaw implant lawsuit. While each patient’s case is different and no compensation is guaranteed, it is still important to consider pursuing a claim.

If successful, you could potentially receive compensation that can help to reimburse you for any pain and suffering, loss of income or loss of earning capacity, and medical costs or bills, including hospitalizations, surgeries, rehabilitation, medication, doctor’s visits, and more. For this reason, it is important to request a consultation with an attorney to learn more about your legal options. The time to file is limited, so contact Attorney Group for Georgia today for more information.
