Kentucky Defective Airbag Lawsuit

Owners of certain Honda, BMW, Toyota, Mazda, Subaru, Nissan, Mitsubishi, General Motors, Chrysler, and Ford model vehicles are being urged by the National Highway Traffic Safety Administration to pay attention to recall notices regarding a potentially defective airbag. More than seven million vehicles are included in the NHTSA’s most recent recall due to the possibility of the airbags releasing metal fragments into the cabin of the vehicles, thus placing the passengers and driver at a high risk of death or life-threatening injuries.

According to the NHTSA, an estimated 12 million vehicles are included in the recall across the globe, and 7.8 million of these are located in the U.S. The NHTSA is particularly urging consumers in the following locations to contact their vehicles’ manufacturers and visit their local dealers as soon as possible to arrange for replacement airbags:

  • Louisiana
  • Mississippi
  • Georgia
  • Alabama
  • Texas
  • Florida
  • Puerto Rico
  • Hawaii
  • Guam
  • Virgin Islands
  • Saipan
  • American Samoa

Vehicle owners in these regions may be more likely to suffer injury or death as a result of the potentially defective airbag as the high temperatures and humidity may be a reason for the lleged defect. However, the NHTSA has not yet determined whether this is the case, but vehicle owners should still consider taking precautions and arrange for alternate airbags to be installed in their vehicles. Consumers who are unsure as to whether their vehicles have been affected may consult the manufacturers’ websites to search their cars by vehicle identification numbers. The NHTSA will continue to investigate the possible cause of the alleged defect.

As a result of the alleged defect, Takata may be named as a defendant in personal injury and product liability lawsuits across the country. In order to pursue a successful claim for damages, the plaintiff must clearly demonstrate the manufacturer’s part was defective, and it was that defect that directly caused the plaintiff to sustain an injury or lose a loved one. Individuals who believe they have been injured by an airbag may consider seeking legal counsel recover damages for the injuries allegedly caused by the company’s airbags. Possible forms of compensation may include pain and suffering, lost wages, and medical expenses.
