What is the CMF Distraction
System?

DePuy Synthes, a subsidiary of Johnson & Johnson, introduced the CMF Distraction System for use in patients requiring jaw stabilization, strengthening, and growth. The device was intended to treat traumatic jaw injuries following accidents in both older children and adults, as well as birth defects in infants and young babies.

What is Happening?

The U.S. Food and Drug Administration (FDA) reportedly received at least 15 claims from patients who suffered from complications as a result of these devices. In response, the manufacturer issued a recall in April 2014 to pull the products from the market. In August 2014, the FDA classified the recall with its most serious rating: a Class I recall. Such a recall is only issued if the product has the potential to cause serious injury or death.

The DePuy CMF Distraction System is comprised of small plates that are attached to the patient’s jawbone, and the process of distracting, or lengthening, the jawbone occurs gradually over time. However, if the device fails prematurely, the screws can reverse direction and cause the implant to no longer function as needed. In adults and children, failure of the implant can be treated with an additional surgical procedure to remove and replace the device. However, the initial recall notice stated that those who already have a compromised jaw anatomy may still be at an increased risk of choking or tracheal obstruction.

The true danger lies in infants that experience early device failure. The FDA acknowledged that, should this happen in young babies, the tracheal obstruction may cause respiratory distress and/or asphyxiation because infants lack the physical ability to “breathe around” the obstruction. Individuals who have lost a child due to alleged complications from the DePuy jaw implant or those who have been injured themselves may wish to seek legal counsel from Attorney Group for Mississippi. Doing so can help determine whether they are eligible to file a DePuy jaw implant lawsuit and seek compensation for their injuries and losses.
